This website is operated by Kurtis Barber, trading as Curly Kurtis Art Studio. Throughout the site, the terms "I", "me" and "my" refer to Curly Kurtis Art Studio.

By visiting this website, purchasing artwork or prints, or requesting a commission, you agree to be bound by these Terms & Conditions.

If you do not agree to these terms, please do not use this website or purchase from me.
 

Products & Pricing:

Curly Kurtis Art Studio sells original artwork, art prints and commissioned artwork.

I reserve the right to:

• Modify or discontinue products at any time

• Change prices and product availability

• Correct pricing or listing errors

• Refuse or cancel an order where reasonably necessary

I make every effort to display artwork accurately. However, colours may vary slightly depending on your screen, device and printing variations.
 

Orders & Payment:

Orders are placed through my Wix online store.

Payments are processed securely through Wix and/or its payment providers. I do not store your complete credit or debit card information.

Once an order is placed, you may receive an order confirmation by email.

I reserve the right to cancel orders where fraud, unauthorised activity or a genuine error is suspected. If an order is cancelled after payment, an appropriate refund will be provided.
 

Commissions:

I accept requests for custom commissioned artwork.

Commission details, pricing and requirements will be agreed upon before work begins. Because each commission is individually created, the final artwork may vary slightly from reference images or examples.

Once work has begun, significant changes or cancellations may not be possible. Any refund will be handled in accordance with applicable Australian Consumer Law.
 

Shipping:

I primarily ship artwork and prints using Australia Post.

Delivery times are estimates and may vary due to postal delays, customs, weather or other circumstances outside my control.

I am not responsible for:

• Delays caused by the shipping carrier

• Incorrect or incomplete addresses provided at checkout

• Customs delays or charges for international orders

• Lost or stolen packages after being marked as delivered

International customers are responsible for any applicable customs duties, taxes or import charges.
 

Returns & Refunds:

Returns and refunds are handled in accordance with applicable Australian Consumer Law.

If your order arrives damaged, defective or incorrect, please contact Kurtismbarber@gmail.com as soon as possible with details and photographs of the issue.

Commissioned artwork may have different cancellation and refund conditions due to its custom nature.

Nothing in these Terms & Conditions excludes or limits any consumer rights that cannot legally be excluded.
 

Intellectual Property:

All artwork, photographs, designs, logos and content on this website are owned by or licensed to Curly Kurtis Art Studio unless otherwise stated.

Purchasing an original artwork, print or commission does not transfer copyright or reproduction rights to the customer.

Artwork may not be copied, reproduced, modified, distributed, resold or used commercially without prior written permission.
 

Commission Artwork:

Unless otherwise agreed in writing, copyright in commissioned artwork remains with Curly Kurtis Art Studio.

The customer receives ownership of the physical artwork but does not automatically receive commercial reproduction or copyright rights.

I may photograph and display completed commissioned artwork on my website, portfolio or social media unless otherwise agreed.
 

Limitation of Liability:

To the maximum extent permitted by law, I am not responsible for indirect or consequential losses arising from the use of this website or products purchased through it.

Nothing in these Terms & Conditions excludes or limits any liability or consumer rights that cannot legally be excluded under Australian law.
 

Governing Law:

These Terms & Conditions are governed by the laws of Queensland, Australia.
 

Changes to Terms:

I may update these Terms & Conditions from time to time to reflect changes to my business, website, services or legal requirements.

The updated version will be published on this website with a new "Last updated" date.
